You are not obliged to provide to us your Personal Data (as defined below). However, we may be unable to provide you with certain Services if you decline to provide such data.

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Privacy Policy:

Account means a unique account created for You to access our Service or parts of our Service.

Application refers to Nexupet, the software program provided by the Company.

Device means any device that can access the Service such as a computer, a cellphone or a digital tablet.

Service refers to the Application.

Service Provider means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.

You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.

System Permissions We Require and Their Purposes

To ensure the proper functioning of the app, we require the following system permissions:

Location Access: This permission allows the application to access the device's location for searching nearby devices and logging into accounts.

Bluetooth Access: This permission allows the application to access Bluetooth for searching nearby devices, specifically for adding devices.

Recording Access: This permission allows the application to use the system microphone for recording audio and engaging in real-time intercom with Nexupet devices.

Storage Access: This permission allows the application to access phone storage for saving and viewing videos and photos recorded by Nexupet devices.

Photo Album Access: This permission allows the application to access the phone's photo album for saving and viewing videos, photos, and setting avatars recorded by Nexupet devices.

Cellular Data and Wi-Fi Network Access: This permission allows the application to use cellular data and Wi-Fi wireless networks for proper device pairing and access.

Notification Permission: This permission allows the application to send notifications to users, specifically for pushing device detection events.

Collecting and Using Your Personal Data

Types of Data Collected

In order to provide our services to you ,we will ask you for personal data that is necessary for us to successfully provide those services. If you do not provide us with this personal data, we may not be able to provide our products or services to you.We will only collect the information that is necessary for its specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes. We may collect the following types of information (which may or may not be personal data):

1) Information You Voluntarily Provide to Us

Registered Account Data: When you register an account with us, we may collect your account name and contact details, such as your Email address.

Other :We may collect other information that you voluntarily provide when you communicate with us.

2) Device and Technical information

Basic Information of Devices:When you connect your Devices with the Services, we may collect basic information about your Smart Devices such as device name, device ID, online status, activation time, firmware version, and upgrade information.

Location Information: Refers to information about your location collected when you enable device location services and use our location-based services. This includes:

Your geographic location information collected through WiFi when using our services on a location-enabled mobile device.

You can stop the collection of your geographic location information by disabling the location function.

Network Information: We need to obtain your mobile network/Wi-Fi's IP address, MAC address, SSID, BSSID, carrier information (such as PLMN, MNC, MCC), and connection method for users to view the network information of the added Nexupet devices.

Audio Recording: When users need to use the summoning voice function within Nexupet, we will obtain system recording permissions after the user's consent and authorization, helping users record audio within Nexupet.

Installed App List: We have integrated third-party push services (such as AWS SDK etc.), which may require access to the list of applications installed on the user's mobile system to locate Nexupet (this software) and achieve the delivery of detection messages to Nexupet devices.

3)Information Collected while Using the Application

While using Our Application, in order to provide features of Our Application, We may collect, with Your prior permission:

Pictures and other information from your Device's camera and photo library

We use this information to provide features of Our Service, to improve and customize Our Service. The information may be uploaded to the Company's servers and/or a Service Provider's server or it may be simply stored on Your device.

You can enable or disable access to this information at any time, through Your Device settings.

Privacy and Security of Nexupet Smart Cameras

· When using Nexupet to watch the live feed and view cloud playback from Nexupet smart cameras, we ensure the secure transmission of data through encryption technology, guaranteeing no data leakage during transmission.

· Without activating Care Cloud, Nexupet smart cameras do not actively record, capture, or store any videos or photos.

· Once the user subscribes to Care Cloud services, Nexupet smart cameras will proactively record and store videos for relevant events (specific triggering conditions can be found on the Care Cloud purchase page within the Nexupet app). Users can view and delete these videos at any time. After the user deletes selected cloud storage videos, the system will permanently destroy the files without any backups.

· Without the user's private key login, no one can access and view the user's camera feed or stored information.

· Please note, we may use a third party payment processor (such as ApplePay or GooglePay) to assist in securely processing your personally identifiable payment information. The credit card information that you provide is encrypted and transmitted directly to ApplePay or GooglePay. We do not store your credit card information and do not control and are not responsible for ApplePay or GooglePay or its collection or use of your information. You may find out more about how ApplePay/GooglePay stores and uses your credit card information by accessing ApplePay or GooglePay’s privacy policy.

We strictly prohibit any internal employees and third parties from directly accessing users' personal data (especially camera privacy) without the user's consent. To ensure the security of users' personal information, we educate all Nexupet employees about the company's privacy and security guidelines and implement stringent privacy protection measures within the company.

Use of Your Personal Data

The Company may use Personal Data for the following purposes:

To provide and maintain our Service, including to monitor the usage of our Service.

To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.

For the performance of a contract: the development, compliance and undertaking of the purchase contract for the products, items or services You have purchased or of any other contract with Us through the Service.

To contact You: To contact You by email, telephone calls, SMS, or other equivalent forms of electronic communication, such as a mobile application's push notifications regarding updates or informative communications related to the functionalities, products or contracted services, including the security updates, when necessary or reasonable for their implementation.

To provide You with news, special offers and general information about other goods, services and events which we offer that are similar to those that you have already purchased or enquired about unless You have opted not to receive such information.

To manage Your requests: To attend and manage Your requests to Us.

For business transfers: We may use Your information to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of Our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Data held by Us about our Service users is among the assets transferred.

For other purposes: We may use Your information for other purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Service, products, services, marketing and your experience.

Share of Your Personal Data

We only share Personal Data in ways that we tell you about. Without your consent, we will not disclose your Personal Data to third-party companies, organizations, or individuals except in the following cases:

· With Service Providers: We may share Your personal information with Service Providers to monitor and analyze the use of our Service, to contact You.

· For business transfers: We may share or transfer Your personal information in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.

· With Affiliates: We may share Your information with Our affiliates, in which case we will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.

If You interact with other users or register through a Third-Party Social Media Service, Your contacts on the Third-Party Social Media Service may see Your name, profile, pictures and description of Your activity. Similarly, other users will be able to view descriptions of Your activity, communicate with You and view Your profile.

· With Your consent: We may disclose Your personal information for any other purpose with Your consent.

In addition, to ensure operations of the App or to enable certain independent functions, we may embed third-party SDKs in the App. Please note: the types of Personal Data that these third-party SDKs may process are subject to change at any time due to upgrade, updates or policy changes, and you should rely on relevant latest information on the official websites or otherwise made available by such third parties. which may include the following examples:

Retention of Your Personal Data

The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.

Delete Your Personal Data

You have the right to delete or request that We assist in deleting the Personal Data that We have collected about You.

Our Service may give You the ability to delete certain information about You from within the Service.

You may update, amend, or delete Your information at any time by signing in to Your Account, if you have one, and visiting the account settings section that allows you to manage Your personal information. Business Transactions

Correct Inaccurate Information – You may have the right to request that we correct inaccuracies in the personal information we maintain about you.  

California Privacy Rights

If you are a resident of the State of California, you have specific privacy rights under California law , which are explained in PRIVACY NOTICE FOR CALIFORNIA RESIDENTS.

Children's Privacy

Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.

If We need to rely on consent as a legal basis for processing Your information and Your country requires consent from a parent, We may require Your parent's consent before We collect and use that information.

We may update Our Privacy Policy from time to time. We will provide notice to you if these changes are material and, where required by applicable law, we will obtain your consent..
